Pregnancy Discrimination Overview

The Pregnancy Discrimination Act amended Title VII of the Civil Rights Act of 1964 to expressly forbid employers and potential employers from discriminating against pregnant employees. Texas law prohibits sex discrimination and Texas includes discrimination based on pregnancy, childbirth, and related medical conditions within sex discrimination.  Employers are prohibited from pregnancy discrimination in

hiring, training, benefits awards and restrictions, compensation, promotions, firing, layoffs, harassment, and other terms and privileges of employment

In practice, pregnancy discrimination often looks like:

  • Declining to hire a qualified employment candidate because they are pregnant
  • Firing a pregnant employee to avoid paying for maternity leave or other benefits, including benefits under the Family and Medical Leave Act (FMLA)
  • Failing to provide reasonable accommodations for a breastfeeding employee
  • Failing to provide reasonable accommodations that are provided to other employees with a disability. For example, if a non-pregnant employee sprains their wrist and is given lighter work duties while that injury heals, a pregnant employee is similarly entitled to lighter work duties due to comparable physical limitations.
