Essure Lawsuit Overview

Essure is a birth control device that has been on the market for years. Many women flocked to the Essure product because it was marketed as being non-hormonal, highly effective, and inserted during a minimally invasive, quick, and relatively painless procedure.

Inserted into a woman’s fallopian tubes, Essure is a permanent birth control device that, if designed correctly, could have been effective birth control.

But it wasn’t designed correctly.

More than 16,000 women have filed lawsuits against Essure’s manufacturers—Bayer and Conceptus—after they suffered severe abdominal damage when the birth control device moved and punctured their uterus and fallopian tubes. As these and other women discovered, the Essure birth control device was defectively designed. That defect causes the device to break apart and injure a woman’s uterus and fallopian tubes.

If the Essure implant separates, breaks, or moves, it must be removed. Unfortunately, attempted removal often requires multiple surgeries and, in some cases, removing the uterus entirely.

Since 2002, the Food and Drug Administration (FDA) has received more than 26,000 adverse event reports related to Essure. The most frequent problems identified have been:

  • Menstrual irregularities
  • Headache
  • Fatigue
  • Weight fluctuations
  • Movement of the device
  • Device operating differently than expected
  • Device breakage

In addition to these problems, the Essure device has been associated with a number of miscarriages.
