TWC Appeals: 5 Simple Steps to Secure the Benefits You Deserve

So, the Texas Workforce Commission (TWC) decided to deny your unemployment benefits. That doesn’t mean the fight is over. You have the right to file an appeal—basically telling the TWC you disagree with their decision and want a second look. Here’s how the process works and what you need to know to protect yourself.

1. Filing a TWC Appeal: Deadlines Matter

The most important thing to know: you only have 14 calendar days from the date the TWC mailed your Determination Notice to file your appeal. Miss that window and your case could be dead in the water.

Here’s the rundown:

  • How to file: Online through the TWC website or in person at your local TWC office

  • Not allowed: Phone calls or emails—TWC won’t accept them

  • Check status: You’ll usually see movement within two to three weeks after filing

Five Must Haves in Your Appeal

When you submit your appeal, make sure you list:

  • Your full name and Social Security number

  • Your current mailing address

  • The date on your Determination Notice

  • Any dates you can’t attend a hearing

  • Any accommodations you need for your hearing

Pro tip: double-check everything before you hit “submit.” The TWC isn’t known for being forgiving about missing info.

2. Prepping for Your Unemployment Appeal Hearing

An appeal hearing is not the time to show up empty-handed. Bring every piece of documentation that backs up your case:

  • Letters, memos, and emails

  • Timecards and attendance records

  • Medical records

  • Photos, maps, or diagrams

  • Work performance records

If your hearing is by phone, you’ll need to register a reliable number no earlier than one hour and no later than 15 minutes before the hearing starts. Don’t risk missing the call—they won’t reschedule because your phone was on silent.

3. Using Witnesses to Strengthen Your Case

Got someone who saw what really happened? Witnesses can make or break your unemployment appeal in Texas.

Here’s how to handle it:

  • Line up your witnesses ahead of time so they’re ready on hearing day

  • Give the hearing officer their names and phone numbers

  • Witnesses can appear in person or testify by phone

Need to subpoena a witness? Talk to the hearing officer. They’ll only grant it if the witness has relevant testimony or documents.

4. What Actually Happens in a TWC Appeal Hearing

Expect the hearing officer to kick things off with a quick roadmap: who’s involved, what the issues are, and how the hearing will run. Then:

  1. Each side presents their case

  2. Witnesses testify and get questioned (by both the officer and the other side)

  3. Documents are reviewed and admitted into evidence

  4. Both sides get a final chance to add testimony

It’s not a full-blown courtroom, but don’t mistake it for casual—your benefits are on the line.

5. After the Appeal: What Comes Next

Within five to ten days, you’ll get the hearing officer’s decision in the mail.

If it doesn’t go your way:

  • You may have to pay back unemployment benefits you already received

  • You can still take your appeal further if you want to keep fighting

You can also request a free recording of your hearing. To do this, send your name, appeal number, the last four digits of your Social Security number, and your phone number to the TWC. Expect to wait a week or two before it arrives.

The Texas Workforce Commission doesn’t make it easy—but filing an unemployment appeal in Texas is your chance to fight back. Pay attention to the deadlines, prepare your documents and witnesses, and know what to expect at the hearing. The more prepared you are, the stronger your chances of getting the benefits you need.
